1. Acceptance of Terms

By accessing or using EchoForge Arcade at arcade.echoforge.games (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. The Service is operated by Echowright LLC ("we," "us," or "our").

2. Description of Service

EchoForge Arcade is a free-to-play browser game platform. The Service provides access to a library of HTML5 games playable directly in your web browser. The Service is provided "as is" and may be modified, updated, or discontinued at any time without notice.

3. Eligibility

The Service is intended for general audiences. By using the Service, you represent that you are at least 13 years of age (or the minimum age required in your jurisdiction). If you are under 18 (or the age of majority in your jurisdiction), you represent that you have your parent or guardian's permission to use the Service.

Certain features (such as leaderboards) may require creating an account.   • Attempt to exploit bugs or vulnerabilities for unfair advantage (including leaderboard manipulation)
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service to transmit harmful, offensive, or illegal content
  • Reverse-engineer, decompile, or disassemble any part of the Service except as permitted by law
  • Circumvent, disable, or interfere with security-related features of the Service
  • Use ad-blocking software that prevents the display of advertisements on the Service

6. Intellectual Property

All content on the Service — including games, graphics, text, code, sound, music, and trademarks — is owned by or licensed to Echowright LLC and is protected by intellectual property laws. You may not copy, distribute, modify, or create derivative works based on our content without prior written permission.

The Service is for personal, non-commercial use only. You may play our games and share links to the Service, but you may not embed, redistribute, or repackage our games on other websites or platforms without authorization.

7. Advertising

The Service is supported by advertising. By using the Service, you acknowledge that advertisements will be displayed and agree not to interfere with their delivery. Advertisements are served by third-party partners (including Google AdSense) and are subject to their own terms and privacy policies.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Game progress saved in local storage may be lost if you clear your browser data, switch devices, or use private/incognito browsing. We are not responsible for lost game progress.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHOWRIGHT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO ACCESS THE SERVICE (WHICH, FOR A FREE SERVICE, IS ZERO).

10. Indemnification

You agree to indemnify, defend, and hold harmless Echowright LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

11. Third-Party Links and Services

The Service may contain links to third-party websites or services (such as our Discord community). We are not responsible for the content, privacy policies, or practices of any third-party sites. Your interactions with third-party services are governed by their own terms.

12. Modifications to Terms

We may revise these Terms at any time by posting the updated version on this page. Changes take effect immediately upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Kansas, United States, without regard to its conflict-of-law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved in the courts located in Kansas.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
